Oakley, Inc. v. Sunglass Hut, Int'l, et al., SACV-01-1065 AHS (MLGx) (C.D. Cal.) Just before the busy holiday shopping season, Oakley's largest competitor introduced a line of eyewear that infringed Oakley's Iridium® lens-coating patent. The firm successfully represented Oakley in obtaining a temporary restraining order and preliminary injunction requiring removal of the infringing products from over 1,000 Sunglass Hut stores nationwide. The firm presented scientific testing demonstrating infringement, and refuted the defendants' patent invalidity theories. The U.S. Court of Appeals for the Federal Circuit affirmed the District Court's decision. Published decisions at 61 U.S.P.Q.2d 1658 (C.D. Cal. 2001) aff'd 316 F.d 1331 (Fed. Cir. 2003). |
