Gart v. Logitech, Inc., [98 CV 5957 CBM (C.D. Cal)] The firm successfully represented the inventor in a patent infringement case to enforce his patent on an ergonomic computer mouse. On an appeal to the Court of Appeals for the Federal Circuit, the firm overturned an erroneous claim construction and obtained a reversal of the district court's noninfringement ruling. Subsequently, the firm defeated Logitech's motion for summary judgment of invalidity. With trial just a month away, the parties settled the litigation, including a consent judgment of validity and infringement. The firm has continued to enforce the patent successfully against numerous other defendants. Published decisions at 254 F.3d 1334 (Fed. Cir. 2001), cert. denied, 122 S.Ct. 921 (2002); 254 F. Supp. 2d 1119 (C.D. Cal. 2003). |
