Irvine, CA, June 25, 2008 - Knobbe Martens Olson & Bear LLP announced today that the U.S. Court of Appeals for the Federal Circuit ruled in favor of its client - Industrial Dynamics Co. Ltd. - and overturned a jury verdict that Industrial Dynamics infringed a patent owned by Heuft Systemtechnik GmbH. The case involved equipment used in bottling plants to inspect bottles for defects. The Federal Circuit agreed that the District Court had incorrectly construed the claims of Heuft's patent and found that Industrial Dynamics did not infringe the claims under the correct claim constructions. more>>

The parties settled their dispute, with AstraZeneca agreeing to allow Ranbaxy to produce the generic version of Nexium as early as May 2014. BIODEFENSE NEWS: AVANIR AND EMERGENT SIGN DEFINITIVE AGREEMENT TO ACQUIRE AVANIR'S ANTHRAX ANTIBODIES
Knobbe Martens represented California-based pharmaceutical company AVANIR Pharmaceuticals (NASDAQ:AVNR) in its recent venture with Emergent BioSolutions (NYSE:EBS). Avanir executed a definitive agreement to sell its portfolio of human monoclonal anthrax antibodies to Emergent. As part of the transaction, Emergent acquired several of Avanir's anthrax antibodies and certain rights to develop new human monoclonal antibodies targeted against Bacillus anthracis using Avanir's proprietary technology. Avanir has the potential to receive up to $1.75 million in upfront and milestone payments, as well as future royalties if the product is commercialized. The Knobbe Martens team involved in the acquisition included Orange County partners Mark R. Benedict, Ph.D. and Salima A. Merani, Ph.D, and associate Terry K. Tullis. SMITH & NEPHEW CASE TRANSFERRED OUT OF EASTERN DISTRICT OF TEXAS
Irvine, CA, January 15, 2008 - Knobbe Martens announced today that the U.S. District Court for the Eastern District of Texas ruled in favor of its client Smith & Nephew, Inc. and granted Smith & Nephew's motion to transfer a patent infringement case brought by Kinetic Concepts, Inc. relating to negative pressure wound therapy. As a result of the decision, Smith & Nephew will not have to defend against the patent infringement claims in the Eastern District of Texas, but will do so in a different jurisdiction in Texas where a Smith & Nephew subsidiary has previously obtained a noninfringement jury verdict on related KCI patents. The transfer decision was one of the first in a patent case by Judge Ward since the Fifth Circuit's landmark ruling in In re Volkswagen II to clarify the transfer standard. The Knobbe Martens litigation team representing Smith & Nephew on the transfer motion included Joseph Re, Brent Babcock, Christy Lea, and Andrew Hall.
APPLIED MEDICAL ALLOWED TO TAKE WILLFULNESS CLAIM TO JURY
Irvine, CA, December 12, 2007 - Knobbe Martens announced today that the U.S. District Court for the Central District of California ruled in favor of its client Applied Medical Resources Corp. in its patent infringement case against U.S. Surgical Corp. and Tyco Healthcare Group. As a result of the decision, Applied Medical may present to the jury at trial its claim that U.S. Surgical and Tyco Healthcare willfully infringed its patent on medical devices known as trocars. Applied has previously proved the defendants willfully infringed at two earlier trials. The latest decision was one of the first since the Federal Circuit's landmark ruling in In re Seagate to explain the kind of evidence sufficient to allow a willfulness claim to go to trial. Masimo Corporation, the inventor of Pulse CO-Oximetry and Read-Through Motion and Low Perfusion pulse oximetry, announced that it has closed its previously announced initial public offering of 11,916,626 shares and that the underwriters of the offering have exercised their over-allotment option and purchased 1,787,494 additional shares of common stock at the public offering price of $17 per share. The firm successfully represented its client, California Expanded Metal Products Co. ("CEMCO") in a patent infringement suit brought by Brady Construction Innovations, Inc. in Santa Ana, California. The firm moved to dismiss the lawsuit immediately after it was filed. Following briefing and oral argument, the Court granted CEMCO's motion, invalidated the asserted patent, and entered judgment in CEMCO's favor on June 14, 2007. CEMCO was represented by Vito A. The firm successfully represented its client, Specialized Bicycle Components, Inc. ("Specialized"), in a patent infringement suit for its revolutionary bicycle shock absorbers on January 18, 2007. The judge awarded Specialized a permanent injunction, attorneys' fees and treble damages.
KNOBBE SUCCESSFULLY DEFENDS TOSHIBA IN PATENT INFRINGEMENT SUIT
The firm successfully defended Toshiba in a patent infringement lawsuit brought in Madison, Wisconsin by Computer Docking Station Corporation ("CDSC"). CDSC, had sued several laptop computer companies with the expectation they could extract settlements for alleged infringement of a patent that covers docking stations. Although some defendants settled, Toshiba and two other accused infringers elected to show the court that the asserted patent was very narrow and did not cover docking stations for laptop computers. After obtaining a favorable claim construction in August, and conducting extensive briefing on two sets of opposing summary judgment motions, the firm and its co-counsel convinced the court in early January 2007 that the case should be dismissed. The court granted summary judgment of non-infringement and dismissed the case on January 12, 2007. Toshiba intends to seek attorneys' fees.

ILLUMINA SIGNS DEFINITIVE AGREEMENT TO ACQUIRE SOLEXA FOR $600 MILLION
Knobbe Martens Olson and Bear LLP represented San Diego-based biotechnology company Illumina, Inc. (www.illumina.com) in its recent acquisition of Solexa (www.solexa.com). As part of the acquisition, Solexa's stockholders will receive, subject to certain "collar" provisions, shares of Illumina common stock valued at $14.00 per Solexa share, which represents a total equity consideration of approximately $600 million. The Knobbe Martens team involved in the acquisition included San Diego partners Michael Fuller, AnneMarie Kaiser, Mallary DeMerlier and Chris Steinhardt, and associates Jerry Hefner Ph.D., Ali Razai and Brenden Gingrich Ph.D. San Francisco partner Andrew Merickel Ph.D. and associate Zi Wong were also involved in the acquisition. Irvine, CA, January 24, 2006 - Knobbe Martens Olson & Bear LLP announced today that its client, Masimo Corporation
of Irvine, California, has settled all existing patent litigation with Nellcor, a division of Tyco Healthcare.
Under the settlement, Nellcor paid Masimo $265 million for damages through January 31, 2006.
In addition, Nellcor made an advance royalty payment of $65 million related to sales of Nellcor's new products
during the remainder of calendar year 2006. After January 31, 2006, Nellcor will no longer ship its oximeters
that were found to infringe in the lawsuit, but will continue to provide service and sensors for previously
sold products. Finally, Masimo has granted Nellcor the right to sell Nellcor's new line of pulse oximetry

the Federal Circuit in Washington D.C. upheld a $64.5 million judgment that Tyco Unit U.S. Surgical Corporation had
willfully infringed a patent owned by the firm's client, Applied Medical Resources Corp. The patent is on a
medical device known as a trocar, used by surgeons to perform laparoscopic surgery. In addition to affirming
the Orange County jury's $43.5 million damages award, the appellate court held that the record supported the
jury's willfulness finding, which allowed the trial court to award increased damages and attorney fees to reach
